Robin D. Merriman II

Senior Associate Attorney
Fort Myers, Florida

Robin D. Merriman II is an experienced trusts and estates attorney at Aloia, Roland, Lubell & Morgan, PLLC. His areas of practice include estate planning, tax planning, probate administration, trust administration, guardianships, and probate and trust litigation.

Robbie was born and raised in Harrodsburg, Kentucky. In 2010, he graduated with Bachelor of Arts from the University of Louisville, double-majoring in Philosophy and Humanities, with a minor in Religious Studies. He then attended the University of Miami School of Law, where he was graduated magna cum laude in 2013. In 2019, Robbie was awarded a Master of Laws (LL.M.) in Taxation from New York University.

After graduation from the University of Miami, Robbie began his legal practice as a trusts and estates attorney in Lee County, Florida. Since 2013, Robbie's practice has been devoted almost exclusively to the trusts and estates area.

In contrast to many trusts and estates practitioners, Robbie's practice encompasses litigation related to trusts and estates matters. For example, Robbie engages in litigation involving the validity of testamentary instruments such as wills, trusts, deeds, or beneficiary designation forms and whether such testamentary instruments were procured by fraud or undue influence or were executed at a time in which the testator or grantor lacked the requisite capacity. Robbie engages in litigation involving the removal or surcharge of personal representatives, trustees, guardians, or other fiduciaries for various breaches of fiduciary duties owed by such fiduciaries, as well as litigation related to the appointment of guardians for alleged incapacitated persons.

Robbie's experience in trusts and estates litigation has the additional effect of strengthening his estate planning practice and probate and trust administration practice, as it helps him advise his clients to avoid traps and pitfalls that regularly give rise to litigation.

Additionally, unlike many trusts and estates practitioners, Robbie's practice also encompasses the administration of taxable estates, which includes the preparation and filing of Estate Tax Returns (Form 706) and Gift Tax Returns (Form 709), as well as tax planning (as a component of estate planning) to minimize federal estate, gift, and generation-skipping transfers taxes due at death.

In his free time, Robbie enjoys spending time with his family. He is a husband and a father to two beautiful children. Robbie is an avid Louisville Cardinals fan, and enjoys playing tennis and basketball, taking weekend trips to Disney World with his family, playing guitar, and going to concerts.
