Finding yourself in a situation where the government is attempting to take your private property is not something the average person would think could happen. However, it could happen and how would you respond?

Eminent domain is the right of federal, state, or local governments to take private property for public usage. All that the government needs to do to take your property through eminent domain is to secure a property valid appraisal and proof that the land will be used for public purpose.

Public works projects include ventures reserved for public safety, health, interest or convenience. Far and away, the most common situation is the taking of the land to build or expand a public road or highway.

The process of eminent domain begins when the government attempts to negotiate the purchase of your property for fair value. "Fair value" is not always cut-and-dry. Negotiating with a state or local government agency can be daunting on your own. If the owner does not wish to sell, then the government will file a court action-resulting in a hearing. During the hearing, proceedings are held to establish the public purpose and valid appraisal.
